There are seven total justices in the 2nd District Court of Appeals including the Chief Justice and Justices. It is one of the 14 appeals courts in Texas.
2nd Court of Appeals
The Second Court of Appeals is composed of seven Justices and has jurisdiction over appeals from district and county courts in twelve north central Texas counties. Cases include civil appeals in which the amount of the trial court’s judgment exceeds $250, exclusive of costs and interest, and all criminal appeals except appeals from cases in which the death penalty has been imposed, which are appealed directly to the Court of Criminal Appeals. The Second Court of Appeals also has jurisdiction over original proceedings—such as writs of mandamus, injunction, prohibition, and habeas corpus—arising from cases in the twelve counties it serves.
IMPORTANT NOTE: 2nd Court of Appeals is a countywide position and when it is up for re-election, it will be on every Tarrant County resident’s ballot.
What is the Court of Appeals?
The 14 courts of appeals have intermediate appellate jurisdiction in both civil and criminal cases appealed from district or county courts. Each court of appeals has jurisdiction in a specific geographical region of the state.
Each court is presided over by a chief justice and has at least two other justices. The specific number of justices on each court is set by statute and ranges from three to 13. Presently there are 80 justices authorized for these courts.
Appeals in the courts of appeals are usually heard by a panel of three justices, unless an en banc hearing is ordered in a particular case, in which instance all the justices of a court hear and consider the case.
